A prenuptial agreement is a written document that is created by two individuals who intend to marry. A prenuptial agreement states the way in which the spouses wish to have their property distributed amongst themselves if the marriage ends in a divorce. A prenuptial agreement may not be recognized as valid in Alabama if the couple does not execute the agreement according to the laws of the state. For example, in Alabama, both spouses must fully disclose their financial situation to one another prior to signing the prenuptial agreement. In addition, the agreement must be made voluntarily and freely without coercion or force by one spouse. Both spouses must have a reasonable amount of time to consider the agreement, and cannot be presented to one party on the day they are to be married.
