Question:

I have been married for 35 years and my husband and I have three adult children, the youngest being 25 yrs of age. I used the Pima County Superior Court self-help forms (answering the initial questions correctly.) It told me to file using the packet for Dissolusion without Children. All forms were filled out and copied but upon presenting them at the clerks office I was told that because I have three children I must use the Dissolusion WITH Minor Children forms. My children are no longer minors and those forms do not apply to my situation. Can you please tell me which forms to use?

Selected Answer:

If your children are over the

If your children are over the age of 18, you should file the divorce packet for dissolution without children because no issues related to your children will be decided in your divorce. However, if minor children are involved in the divorce, the court will decide issues related to the custody of the children and the amount of child support to award. Since these issues do not apply to you and may result in your divorce taking longer to finalize if you file this packet, you should file for dissolution without children. If you have additional questions about how to file for divorce in Arizona, including which form to file, discuss your options with an attorney. In addition,  you can contact the director of the law library in your county if you cannot afford legal representation http://www.sc.pima.gov/?tabid=60.
