Though not required, it is advised that you check your corporate name for availability before filing any applications. There are a variety of ways to check name availability through the Texas Secretary of State. Simply visit their Public Information section and determine which route you want to take.

Texas offers two ways to incorporate. Online and via mail. To file via mail, you will need to fill out Form 201 (Revised 12/09) Certification of Formation, For-Profit Corporation. Detailed instructions on filling out the form are available on the first page of the packet. The filing fee for a for-profit corporation is $300. The completed forms and duplicate forms can be submitted to: Secretary of State, P.O. Box 13697, Austin, TX 78711-3697, or faxed to: (512) 463-5709. To file online, you can use the SOSDirect system, provided by the Secretary of State. You will need to set up a user account and make sure your system has all of the necessary requirements for the Web site to run smoothly.

Annual reports can also be filed using SOSDirect. You will receive a notification in the mail when your annual report is due.
