How to File a Small Claim in Will County

The Wills County, Illinois, is responsible for maintaining the records of all the traffic, criminal and civil cases, including the small claims in the small claims court. The office of the Wills County is responsible for recording filed documents. You will have to file your small claims here and as usual, the forms are available online for free download. The first step involves filling out the small claims complaint, where you will have to state the reason why you are suing the defendant. The forms can be downloaded from Small Claims Complaint and you will have to fill out the Summons (Small Claims) which will notify the other party involved. The fee structure varies depending on the amount you are filing for, but the basic fee is $101 and can go up to $236. It is to be noted here that the maximum amount that you can file for in the Will County, is $10,000.


 In the Will County you can file for a small claim in the following circumstances:

  • If your landlord refuses to return your security deposit even though you have handed over the apartment in good and undamaged condition
  • If your employer refuses to pay the wages that he owes you
  • If any property is damaged by someone and he refuses to pay up for it
  • If you buy something from the store and it does not work and the storekeeper refuses to return your money. 

 In any of these cases, you are supposed to present every possible document in your favor so that you win the case.


 After filing the case and notifying the defender, the court gives you a specified date and time when the case would be heard and both you and the defender need to be present there. As with any other small claims courts, you do not need an attorney to present yourself and you can fight for yourself, as the cases are quite simple. However, if you do need an attorney you can hire yourself one who will fight for you. The evidences that you will bring to support your case should be convincing enough to have the judgement in your favor. If you have a witness to your favor, you can also send a subpoena to him so that he appears at the court on the specified time and date.
