Alimony is spousal support awarded to one spouse following a divorce. Alimony is awarded based upon need after the court considers numerous factors including the length of the marriage and each spouse’s ability to support themselves given their working relationship during the length of the marriage. In Utah, if the spouse receiving alimony remarries, the alimony award automatically terminates. Therefore, it is not necessary to notify the court regarding the ex-spouse’s changed marital status. According to Utah Code 30-3-5, alimony may also terminate if you can establish that your ex-spouse is cohabitating with another person, even if they are unmarried.
