I have two children. I just found out that I am pregnant with my third but with my boyfriend not my ex husband. We plan on getting married and he would like to adopt my other children. Their "father" has not seen them since some time in early 2011. He is suppose to pay child support but i haven't seen any of that ever. We have been separated for over 2 years and legally divorced since july 29, 2011. I currently have sole physical and legal custody of the children. I want him to give up his rights but I know he wont. Is there anything I can do to get his rights taken away?

It is necessary for the father’s parental rights be terminated before your boyfriend can legally adopt the children. Parental rights can be terminated voluntarily or if the court finds termination necessary. Generally, it is very difficult to terminate parental rights if the parent does not agree to the termination. However, there are several reasons that the court will grant the request. For example, if the parent has abandoned, neglected or abused the child the court will termination parental rights in Utah. If your ex-husband has not communicated with your children for six months or longer, you may be able to show abandonment. Once you show that your ex-husband abandoned your children, the court then must find clear and convincing evidence of abandonment and then consider whether it is in the best interests of the children to terminate the father’s parental rights. Be aware, however, that your ex-husband only needs to provide minimal evidence of communication with your children to challenge a finding of abandonment.
