Illegal Eviction Procedures in California

California landlords must follow specific rules and procedures when evicting a tenant (California Tenants’ Rights for details). The state forbids landlords from taking the law into their own hands. Examples of illegal “self-help” evictions include changing the locks, taking the tenant’s belongings, removing the front door, or turning off the heat or electricity. check to learn more.

This is the process whereby a landlord forces a tenant to move out of the rental.  It can be a traumatic event.  Sometimes there are good reasons to evict a tenant.  Other times, the tenant faces an eviction because, unfortunately, the law in many California jurisdictions allows a landlord to evict a tenant for no reason. check to learn more.

CALIFORNIA EVICTION PROCESS

If a Tenant in California is in violation of their lease, either by breaking the terms of lease or by not timely paying rent, the first thing the Landlord should do is serve them with a California 3-Day Eviction Notice. Serving the 3-Day Notice to the tenant can be accomplished in one of three ways; check to learn more.

I haven’t received an notice,

I haven’t received an notice, the home went up for auction 09-12-2018. No one bought it, the Celink Bank took ownership and I haven’t received anything in writing. This home was a part of my mother’s living trust and mother had placed a reverse mortgage on the home. My family and I was in the process of purchasing the home; we ran in to a lot of delays. We were under the impression that we were going to close on the home at the end of August, the escrow was paid, the home had been appraised, we paid $500 for a 203k inspector for the home and lastly, we did some upgrades on the home to get the property value up. As it got closer to our deadline we were having difficulty getting our Realitor to return calls. We were informed that we had to do another loan and it was not enough time to secure one. He exuasted all of our extensions. Is there anyway you can help us.
