When you plan a separation or divorce from your spouse, it is a very difficult time and its worst when you have kids. There are a few things which you should know when you opt for family law. Divorce and child care are two major issues that often come up in family law. There are several issues that you need to know and some of them are mentioned below:

  • Parents should take the responsibility of their children. As a family, both the parents are responsible for their children’s welfare. But when you plan to separate, you need to share children’s upbringing, education in general their well-being.
  • It is your duty as a parent to give security to your kids. You could work out a schedule or a plan with your partner and take care of your child’s needs.
  • If you are unable to work-out things with your partner, you could opt for a parenting plan. You can write down your arrangements on a paper and put it in action. You could decide the time spend by each parent with the kids, who takes the major decisions concerning them and so on. This could be an informal agreement between the two or could be a part of the legal separation agreement or court order.
  • If you are unable to agree on who should have the custody of the kids, you could take legal advice and go to court. The judge might ask for an assessment by a social worker, psychiatrist, clinical investigator or psychologist. He/she would report the court and submit the reports and the judge decides keeping the child’s best interest in mind on which parent gets the custody.
  • If a court or separation agreement gives you the custody of your children, they usually will live with you. This gives you the right to make important decisions about their education, welfare etc.
  • In a joint custody, both the parents have equal share in taking decisions about the welfare of the kids. To make a joint custody work, both the parents need to communicate even though they do not live together. This is very important as it could have its impact on the emotional state of your children

These are a few things which could help you. If you get the custody and you are a single parent with a low income, you can approach child support to get financial help from your spouse. This child benefit helps you to give your child a better life. It is the responsibility of both the parents to support their children financially.
