California recognizes a grandparent’s right to visitation of grandchildren. For example, if a parent has died or the parents are divorced, the court may award visitation to a grandparent if the court finds the visitation to be in the best interests of the child. To award visitation, the court looks at several factors including whether the grandparent and grandchild have a pre-existing bond. Next, the court considers the child’s interest in the visitation and a parent’s right to choose whether their child sees a grandparent. Generally, if both parents are married, a grandparent cannot file for visitation rights.
