California recognizes legal separation as an alternative to divorce for those that wish to remain married but do not wish to live together and want to make financial decisions independently of one another. In addition, some religions prohibit a couple from divorcing. To file for legal separation in California, it is not necessary to meet California’s residency requirement. To begin the process for legal separation in California, you must complete a petition, Form FL-100. This is the same form that you would complete if you were filing for divorce. You will file the form with the court clerk in the family law court in either your or your spouse’s county of residence. You then must serve your spouse with a copy of the filed documents. You can find additional details about legal separation at http://www.freelegalaid.com/nav/california/divorce-and-family-law/article/legal-separation-california. Filing for legal separation is a big decision and it always a good idea to speak to an attorney in your area.
