This page outlines the Terms of Use (hereafter the “Agreement”) under which the FreeLegalAid services (hereafter the “Services”) and the www.freelegalaid.us  website (hereinafter the “Site”) are provided to you.

Please read this page carefully. By using the Site and/or Services, you are indicating your acceptance to be bound by this Agreement.   If you’re unwilling to be bound by this Agreement, do not use this Site or use its Services.  

 

YOU AGREE THAT BY USING THE SITE AND THE SERVICES YOU ARE AT LEAST 18 YEARS OF AGE AND YOU ARE LEGALLY ABLE TO ENTER INTO A CONTRACT.

By entering into this Agreement you further acknowledge your understanding and acceptance of FreeLegalAid’s information gathering, use and dissemination practices as outlined in our Privacy Policy, as defined below.

Please note that FreeLegalAid may revise the Agreement at any time by updating this posting. You should visit this page periodically to review the Agreement, as it is binding upon you.

The Services and Site are not intended to create any attorney-client relationship, and your use of FreeLegalAid does not and will not create an attorney-client relationship between you and FreeLegalAid.  Furthermore, any use of the comment system or forum discussion board will not create an attorney client relationship between you and any third party user of FreeLegalAid.  It is expressly probhibited to intentionally enter into an attorney client relationship or distribute legal advice through FreeLegalAid. 

 

Privacy Policy

FreeLegalAid has no obligation to monitor the Site, or prevent parties not under FreeLegalAid’s control from obtaining information about you. FreeLegalAid does not collect information about users for sale or use by third parties.  You agree that FreeLegalAid has the right to monitor the Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Site properly, or to protect itself or its subscribers. FreeLegalAid will not intentionally monitor or disclose any private electronic-mail message unless required by law. FreeLegalAid reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.

FreeLegalAid cannot ensure or guarantee privacy for users. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and FreeLegalAid and its affiliates and related companies shall be relieved of all liability in connection therewith.

You authorize FreeLegalAid to collect from any party and to retain all relevant information relating to your use of the Site, and you hereby authorize any party to provide us with such information. You understand and agree that unless you notify FreeLegalAid to the contrary by e-mailing us, you further authorize FreeLegalAid to disclose, on a confidential basis, to any party with whom FreeLegalAid has business relations all relevant information relating to your dealings with us and the FreeLegalAid Site.

When we license content from a third-party, we may be required to share your personal information with that licensor as a requirement of our license.  However, we will not share your information unless we have been assured by the licensor that your personal information will not be distributed or resold.  

 

Our Services

FreeLegalAid does not offer legal advice. FreeLegalAid expressly prohibits third party users from offering personalized legal advice.

FreeLegalAid offers a collection of free legal information including but not limited to: general informational articles, sample legal documents, vocabulary of legal terms, and a forum discussion board.  In addition, FreeLegalAid provides the ability to search for third party web sites that MAY offer free legal information and/or services.  We also offer third-parties the ability to pay to list their site with FreeLegalAid on the freelegalaid.com website.  We do not evaluate any such listing, and make no guarantee with regard to such third-part or information.

 

Reviews, Comments, Communications, And Other Content.

At various locations on the Site, LegalZoom may permit visitors to post reviews, comments, and other content (the “User Content”). Contributions to, access to and use of the User Content is subject to this paragraph and the other terms and conditions of these Terms of Use.

Rights and Responsibilities of FreeLegalAid:

FreeLegalAid is not the publisher or author of the User Content. It is a passive service for storage and dissemination of the ideas and opinions that FreeLegalAid users may choose to post and distribute as User Content. FreeLegalAid does not screen works before they are posted, and no prior approval is required for posting. FreeLegalAid disclaims all copyright and ownership in such works and all responsibility for them.

FreeLegalAid has the right, in our sole and absolute discretion, to (i) edit, redact or otherwise change any User Content, (ii) re-categorize any User Content to place it in a more appropriate location or (iii) pre-screen or delete any User Content that is determined to be inappropriate or otherwise in violation of these Terms of Use, including but not limited to User Content containing offensive language and unauthorized advertisements.

FreeLegalAid reserves the right to refuse service to anyone and to cancel user access at any time.

Rights and Responsibilities of FreeLegalAid Users or Other Posters of User Content:

You are legally and ethically responsible for any User Content – writings, files, pictures or any other work – that you post or transmit using FreeLegalAid that allows interaction or dissemination of information. In posting User Content, you are responsible for honoring the rights of others, including intellectual-property rights (copyright, patent and trademark), the right to privacy and the right not to be libeled or slandered. For example, if you wish to post a copyrighted work as User Content, you are responsible for obtaining the copyright holder’s permission first.

In posting a work as User Content, you authorize other members who have access to that service to make personal and customary use of the work, including creating links or reposting, but not otherwise to reproduce or disseminate it unless you give permission for such dissemination. You also give permission to FreeLegalAid to copy your works as part of the normal backup process. You have the right to remove any of your works from User Content at any time. —–Derivative of copyright can register, consent for sale. waive copyright.

FreeLegalAid does not want you to submit confidential or proprietary information to us through this Site. All comments, feedback, information or material submitted to FreeLegalAid through or in association with this Site shall be considered non-confidential.  As all comments and other posts are avaible to the public via the web site, such information is easily accessible to the public. Do not post personal or private information. 

The use of your FreeLegalAid user account or posting User Content for any illegal activity under the laws of Nevada and the United States is a violation of these Terms of Use. Since the law as to jurisdiction of online systems is unsettled, we urge you to consider the possible effect of laws outside FreeLegalAid’s locality or your own residence. FreeLegalAid is open to members worldwide (and works published on the World Wide Web, Usenet or other such services are accessible to anyone on the Internet), and FreeLegalAid cannot guarantee that you won’t run into legal trouble in other jurisdictions over your posting.

Your Rights and Responsibilities as a FreeLegalAid User and Reader of User Content:

You are not required to provide your real name when signing up as a user of FreeLegalAid. FreeLegalAid permits anonymous or pseudonymous accounts. Any user may request that such member’s e-mail address be hidden to provide for additional privacy.

If you have a complaint about the behavior or posts of another user, it is your responsibility to attempt to resolve the conflict, typically by contacting that person directly, if possible. Normally, FreeLegalAid staff will not take a role in mediating conflicts between you and other users. FreeLegalAid does not take responsibility for your behavior or that of other users. Notwithstanding the foregoing, if such a complaint or conflict arises, the user or users may request that a FreeLegalAid moderator intervene and attempt to resolve any such dispute. Any such request is not a guarantee that a moderator will (i) intervene, (ii) intervene in a timely manner, (iii) resolve the dispute in favor of one party or the other or (iv) successfully resolve the situation. The decision to intervene rests with FreeLegalAid, in our sole and absolute discretion.

Your access to the postings that users have posted as User Content is for your personal use only. If you want to redistribute postings you find as User Content, it is your responsibility to obtain permission from the poster (and any other person with rights in such work).

 

Intellectual Property Rights

Our Site (including but not limited to text, graphics, images, logos, buttons, icons, software and other materials, not including the specific downloadable content, hereafter “Content”) are the sole property of FreeLegalAid, and are protected by U.S. copyright and international treaties. FreeLegalAid authorizes you to view and download a single copy of the Content on the Site solely for your personal, noncommercial use.

FreeLegalAid hereby grants you permission to download, view, copy and print the Content on any single, stand-alone computer solely for your personal, informational, non-commercial use provided that (i) the copyright and trademark notice appearing below appears in such Content, (ii) the Content is not used on any other web site or in a networked computer environment and (iii) the Content is not modified in any way. This permission terminates automatically without notice if you breach any of the terms or conditions of these Terms of Use. On any such termination, you agree to immediately destroy any downloaded or printed Content. Any unauthorized use of any Content contained on this Site may violate copyright laws, trademark laws, laws of privacy and publicity and communications regulations and statutes.  You may not reproduce, modify, display, sell, or distribute the Content, or use it in any other way for public or commercial purpose. This includes copying or adapting the HTML code used to generate Web pages on the Site.   Additionally attempting to decipher, recompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Site or service is expressly prohibited.

All Site designs, copy, graphics and logos and certain other names or logos are service marks or trademarks of FreeLegalAid.  In addition, the “look” and “feel” of the Site (including color combinations, button shapes, layout, design and all other graphical elements) are also protected by FreeLegalAid’s trademarks, service marks and copyrights. All other product and service marks contained on the Site are the trademarks of their respective owners.

You agree to be bound by third party licenses of software or content that is available or part of the Site and to abide by the terms of use of any such third party software or content.

 

Acceptable Use of the Site

The Site and its Services are intended solely for individuals that are searching for information that has been collected on the site.   If you need legal advice, you should hire a qualified attorney.  This site only contains general legal information and a directory of third party websites that may have law related self help and other law related information.

As one of the conditions of your use of the Site and Service, you represent, warrant and agree that you will not use (or plan, encourage or help others to use) the Site for any purpose or in any manner that is prohibited by this Agreement or by applicable law. It is your responsibility to ensure that your use of the Site complies with this Agreement.

 

Security Rules

Users are prohibited from violating or attempting to violate the security of the Site, including, without limitation: accessing data not intended for such user or logging into a server or account which the user is not authorized to access; attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the   Site, overloading, “flooding”, “mail bombing” or “crashing”; sending unsolicited e-mail, including promotions and/or advertising of products or services; forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.

If FreeLegalAid’s technical staff finds that files or processes belonging to a member pose a threat to the proper technical operation of the system or to the security of other members, FreelegalAid reserves the right to delete those files or to stop those processes. If the FreeLegalAid technical staff suspects a user name is being used by someone who is not authorized by the proper user, FreeLegalAid may temporarily disable that user’s access in order to preserve system security. In all such cases, FreeLegalAid will contact the member as soon as feasible.

Use of any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any activity being conducted on the Site, or taking any action which imposes an unreasonable or disproportionately large load on the Site’s infrastructure is expressly prohibited.  

Violations of these Security Rules may result in civil or criminal liability. FreeLegalAid will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

 

Username and Password

You are responsible for maintaining the confidentiality of your information, username and password.  You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify FreeLegalAid of any unauthorized use of your registration, information, username or password.

 

Indemnification

By using the Services you agree to defend, indemnify and hold harmless FreeLegalAid from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from this Agreement, your breach of this Agreement, your conduct or your use of the Site and Services.  

 

Release and Limitations of Liability

You further agree to release FreeLegalAid from any claims, demands and damages (actual, consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with this Agreement.  

IN NO EVENT SHALL FREELEGALAID BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, INCOME, OR DAMAGES RESULTING FROM LOST DATA, INNACURATE INFORMATION, OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, SITE AND THE CONTENT AND/OR ANY DOCUMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FREELEGALAID IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.   IF THIS EXCLUSION OR LIMITATION OF LIABILITY IS HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THEN FREELEGALAID’S MAXIMUM LIABILITY FOR ANY TYPE OF DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES PROVIDED HEREUNDER.

 

Warranties

By entering into this Agreement you acknowledge that FreeLegalAid is simply providing a searchable collection of third-party information, and that it makes no warranties of any kind relating to the data, documents, or products.  

Furthermore nothing on the Site shall be considered an endorsement, representation, assumption of responsibility or warranty with respect to any third party, whether in regards to their web site, products, technologies, services, business practices or otherwise.

FREELEGALAID DOES NOT WARRANT THAT ITS SITE OR SERVICES WILL OPERATE ERROR-FREE OR THAT THE SITE OR ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS.   IF YOUR USE OF THE SITE OR THE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, FREELEGALAID IS NOT RESPONSIBLE FOR THOSE COSTS.

YOU ASSUME FULL RESPONSIBILITY AND RISK FOR USE OF THIS SITE AND THE INTERNET IN GENERAL.   THE SITE AND CONTENT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT ANY WARRANTIES OF ANY KIND.   FREELEGALAID, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.   FREELEGALAID MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS AND LINKS.

 

Arbitration

Arbitration is the exclusive means of resolving any disputes arising from the an this agreement. A party may demand that any such dispute be resolved by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and each party hereby consents to any such disputes being so resolved. Judgment on the award rendered in any such arbitration may be entered in any court having jurisdiction. Any arbitration under this Agreement will take place on an individual basis; class arbitration and class actions are not permitted.

 

General Provisions

FreeLegalAid makes no claims that the Content of its Site is appropriate or legal to be viewed by certain persons or in certain countries. If you access the Site or Services from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

Partial Validity: If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.

Equitable Relief: You understand and agree that due to the nature of this Agreement, in addition to money damages, FreeLegalAid will be entitled to equitable relief upon a breach of this Agreement by you.

Governing Law: This Agreement is governed by the laws of the State of Nevada without respect to its conflict of laws principles. Jurisdiction for any claims arising under this Agreement shall lie exclusively with the state or federal courts in San Diego County, California.

Entire Agreement: Except as expressly provided in a particular Legal Notice, Software License or other notices or Content published on the Site, these terms represent the entire binding Agreement between us, and our respective successors and assigns, and supersede any and all prior understanding, statements or representations, whether electronic, oral or written, regarding FreeLegalAid, the Site, or Services.

Digital Admissibility: You hereby agree that a printed version of this Agreement and of any other notice given in electronic form by FreeLegalAid or in the Site, which is based upon or relating to this Agreement, shall be admissible in judicial or administrative proceedings and subject to the same conditions as other agreements, business documents or records originally generated, entered into, signed or maintained in printed form.
