At the time you file for divorce in Texas, you will be asked to pay a filing fee. If you cannot afford to pay the filing fee, you may be able to have the fee waived by completing an affidavit of inability to pay costs. To apply for a waiver, complete the form available at http://www.lanwt.org/txaccess/forms/afin.pdf. The clerk can submit the form to the judge for you, or  you may need to appear before the judge in certain circumstances to explain why you believe you are eligible for a fee waiver. If the court grants the affidavit, you will not have to pay the filing fee, but you will still be responsible for other costs of the divorce including legal fees.
